Effective Date: June 03, 2025

Last updated: October 20, 2026

Entity: VerifiedID LLC (“VerifiedID,” “we,” “us,” or “our”)

Services Covered: Our website, user interfaces, mobile apps, automated workflows, and the TruCheck™ verification suite (together, the “Services”).

1. Acceptance of Terms & User Roles

These Terms of Use (“Terms”) apply to everyone who uses the Services. This includes corporate clients, job candidates, and current employees. By using the Services, you agree to these Terms. If you do not agree, you must stop using the Services right away. You confirm that you are at least 18 years old and have the legal right to accept these Terms.

User Categories & Obligations:

  • Corporate Clients (“End Users”): Before you start any screening, you must get every candidate authorization and standalone consent required by the Fair Credit Reporting Act (FCRA). You are fully responsible for carrying out the required Pre-Adverse and Final Adverse Action steps.
  • Candidates and Employees (“Verification Subjects”): You agree to provide real, unexpired, and unaltered ID documents. You confirm that all personal data you provide is your own. You consent to the capture of live video, IP addresses, device data, biometric identifiers, and metadata. We use this data only to confirm your identity, verify your right to work, and prevent fraud.

2. Description of Services

VerifiedID provides background screening, credential checks, and risk reduction services. The Services include:

  • Traditional Screening: Criminal background checks, employment and education checks, motor vehicle records (MVR), drug tests, credit history checks, and reference checks.
  • The TruCheck™ Suite: Live verification sessions with video liveness checks, secure location checks, IP checks, and cross-checks of data from several sources. The suite also checks work authorization documents, such as Form I-551, Form I-766, Form I-94, and Form I-797. Some of these checks use government systems like the USCIS Torch API.

3. Data Retention, Account Closure & Deletion SLA

To comply with data protection laws (including the CCPA and FCRA), we follow clear rules for how long we keep data and how accounts are managed:

  • Permanent Data Deletion SLA: You can ask us to permanently delete your personal data at any time. To do this, email privacy.trucheck@verifiedid.co. We will complete the deletion within thirty (30) calendar days after we verify your request. Some data may be kept where the law requires it.
  • Account Closure: You can close your account at any time. Contact customer support at support@verifiedid.co, or send a request from your account settings.
  • Dormant Account Retention Policy: We keep inactive accounts for seven (7) years. This meets FCRA Section 605 record-keeping rules and our fraud detection rules across clients. After seven years, all stored data and audit logs for the inactive account are automatically and permanently erased from our active systems.

4. Privacy Practices, Data Sharing, & No-Sale Prohibition

Protecting your privacy and data is central to our work:

  • No Selling of Data: We do not sell, rent, lease, trade, or otherwise make money from user data. This includes personal, biometric, and work authorization data.
  • Data Use & Sharing Restrictions: We use the data we collect (such as identifiers, biometrics, document images, and network data) only to provide verification services, detect fraud, and meet law enforcement requirements.
  • Third-Party Limits: Third parties may not use or disclose user data for any purpose other than providing the TruCheck™ service without the user's active consent. This also applies to de-identified, anonymized, or pseudonymized data. All of our sub-processors and infrastructure partners are bound by contract to the terms, security standards, and privacy protections in our policies.

5. Prohibited Conduct & System Integrity

You must not harm the security or integrity of the Services. You agree that you will not:

  • Submit false, forged, altered, fake, or misleading identity records or documents, or stolen Social Security Numbers. Submitting fake documents is a crime under state and federal law (including 18 U.S.C. § 1028, 18 U.S.C. § 1028A, and 18 U.S.C. § 1546).
  • Block, disrupt, alter, or fake live video, biometric data, or device location (for example, by using a VPN or a virtual camera).
  • Reverse engineer, decompile, or take apart the Services, or try to find their source code, computer vision systems, or private APIs.
  • For Corporate Clients: Download, export, screen-capture, or save a local copy of any source images or live video uploaded in TruCheck™.

6. Intellectual Property & Neutral Agency Limits

VerifiedID LLC owns all software code, user interface designs, logos, trademarks, and status methods. This includes the "Clear" vs. "Review Required" decision matrix.

  • No Employment Decisions: VerifiedID acts only as a neutral Consumer Reporting Agency (CRA). We do not make hiring, retention, or adverse employment decisions. Our results are flags that the client must review carefully.
  • Law Enforcement & Fraud Reporting: VerifiedID has the unrestricted right to investigate and report suspected identity theft, stolen SSNs, organized crime, or fake documents to federal and state authorities. These include the FBI (IC3), U.S. Homeland Security Investigations (HSI), the U.S. Secret Service, the Social Security Administration OIG, and other government agencies. We may do this without prior notice.

7. Data Breach Notification & Ownership Transfers

  • Data Breach Notification Protocol: If a confirmed security incident or data breach exposes user data, we will notify affected users, enterprise clients, and regulators without unreasonable delay. The notice will explain in plain language what happened and what types of data were affected. It will also tell you what steps you can take to protect yourself.
  • Transfer of Ownership or Business Closure: VerifiedID may merge, be acquired, reorganize, or sell its assets. If this happens, we will notify users before the transfer. The new owner will be required by contract to follow these Terms and our privacy commitments. Before the transfer is complete, you will have clear options to securely download, transfer, or permanently delete your stored records.

8. Active Consent for Policy Changes

We may update these Terms to reflect legal or platform changes. When we make important changes, we will:

  • 1.Notify users by email or with a clear notice in the portal.
  • 2.Provide a plain-language summary of all key changes.
  • 3.Ask for your active consent (such as clicking to accept) before the updated Terms take effect.

9. Disclaimers, Liability & Governing Law

The Services are provided “as is” and “as available,” without any express or implied warranties. To the fullest extent allowed by law, VerifiedID LLC is not liable for indirect, incidental, special, or consequential damages. This includes damages caused by data mismatches or by how a client reads results when hiring.
