VerifiedID LLC — Terms of Use
Effective Date: June 03, 2025
Last updated: July 7, 2026
Welcome to VerifiedID LLC (“VerifiedID”). These Terms of Use (“Terms”) govern your access to and use of the VerifiedID website, user interfaces, mobile-responsive applications, automated workflows, and the TruCheck™ verification suite (collectively, the “Services”).
By accessing, viewing, or utilizing the Services—whether as a corporate client, prospective job candidate, or an active employee undergoing a verification audit—you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Services immediately.
1. Acceptance of Terms
By using the Services, you represent and warrant that you are at least 18 years of age, possess the legal authority to enter into these Terms, and agree to comply fully with all applicable local, state, federal, and international laws and regulations.
2. Description of Services
VerifiedID provides comprehensive consumer background screening, credential authentication, and risk-mitigation solutions to authorized businesses and organizations. The Services include, but are not limited to:
- Traditional Screening: Criminal background checks, employment and education verifications, motor vehicle records (MVR), drug screening, credit history checks, and reference verifications.
- The TruCheck™ Suite: Proprietary, interactive verification sessions encompassing real- time video liveness assessments, cryptographic geolocation and IP address auditing, multi-source data cross-referencing, and automated right-to-work or regulatory document extension evaluation (including Form I-551, Form I-767, Form I-94, and Form I-797 baseline matching).
3. User Roles and Specific Obligations
Depending on your interaction with the Services, specific responsibilities apply:
- For Corporate Clients (“End Users”): You agree to obtain all legally mandated candidate disclosures, authorizations, and standalone consents required under the Fair Credit Reporting Act (FCRA) and relevant state statutes prior to initiating any screening or audit request. You assume full, non-delegable responsibility for executing mandatory Pre- Adverse and Final Adverse Action legal workflows if a TruCheck™ report or background check informs an unfavorable employment decision.
- For Candidates and Employees (“Verification Subjects”): You agree to present genuine, unexpired (unless accompanied by a valid regulatory extension notice), and unaltered government-issued identification documents during your live session. You explicitly consent to the capturing of real-time video streams, IP addresses, and metadata solely for the purpose of validating identity and employability consistency.
4. Prohibited Conduct and System Integrity
Users are strictly prohibited from compromising the security, integrity, or operational frameworks of the Services. You explicitly agree that you shall not:
- Submit false, forged, altered, or misleading documentation, identity records, or electronic signatures.
- Intercept, disrupt, manipulate, or attempt to spoof live video feeds, biometric streams, or device geolocation parameters (including the use of virtual private networks [VPNs], proxy servers, or virtual cameras to mask actual geographical coordinates).
- For Corporate Clients: Download, export, cache, screenshot, screen-record, frame- capture, or locally archive any source images, interactive video session data, or original document assets uploaded or captured within the live TruCheck™ secure ecosystem.
- Attempt unauthorized access to the server infrastructure, database tables, or proprietary data validation loops of VerifiedID.
5. Intellectual Property
All platform layouts, software code, user interface designs, logos, trademarks, data assessment structures, and algorithmic status methodologies (including the "Clear" vs. "Review Required" triage matrix used across the TruCheck™ Identity, Employability, and Geolocation tracks) are the exclusive intellectual property of VerifiedID LLC or its licensors. No license, download privilege, or transfer of proprietary design rights is granted by your temporary interaction with the platform.
6. Neutral Agency and Evaluation Limitations
VerifiedID acts strictly as a neutral data compiler and analytical reporting platform.
- No Employment Determinations: VerifiedID does not make hiring, retention, placement, disciplinary, or termination decisions. All system outputs (including a status of "Review Required") represent data flags indicating information anomalies that require further client due diligence. The final determination to engage or terminate an individual rests solely and exclusively with the corporate client.
- No Legal Advice: Any automated tools, checklist workflows, or letter templates provided by VerifiedID (such as automated adverse action notification modules) are intended for administrative convenience only and do not constitute formal legal counsel.
7. Disclaimers
The Services are provided on an “as is” and “as available” basis. VerifiedID makes no warranties, express or implied—including any implied warranties of merchantability, fitness for a particular corporate policy, or that the system will detect 100% of all identity spoofing, proxy- hiring, or documentation fraud attempts. VerifiedID does not guarantee uninterrupted or error- free terminal access during localized network disruptions.
8. Limitation of Liability
To the fullest extent permitted by law, VerifiedID LLC, its parents, affiliates, officers, or directors shall not be held liable for any indirect, incidental, consequential, special, or punitive damages—including lost profits, operational disruptions, or third-party workplace claims—arising out of or related to data discrepancies, report delivery timelines, or a corporate client’s business interpretation of platform status classifications.
9. Indemnification
You agree to indemnify, defend, and hold harmless VerifiedID LLC and its affiliates, officers, employees, and authorized agents from and against any third-party claims, lawsuits, administrative penalties, liabilities, or expenses (including reasonable attorneys' fees) arising directly or indirectly from your violation of these Terms, submission of fraudulent identification assets, or failure to execute mandated FCRA compliance workflows.
10. Governing Law and Jurisdiction
These Terms shall be governed, construed, and enforced in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be litigated exclusively in the state or federal courts located in Fulton County, Georgia.
11. Changes to These Terms
VerifiedID reserves the right to amend, update, or restructure these Terms at any time to reflect changing regulatory requirements or platform feature enhancements. Continued use of the website or platform interfaces following the posting of an updated revision date constitutes your mandatory acceptance of the revised Terms.
