Verified.ID provides background screening services to businesses and authorized entities ("Clients"). Our Services include, but are not limited to, criminal records checks, employment verification, education verification, motor vehicle records checks, drug screening, credit history checks, reference checks, and identity verification. All Services are provided in compliance with applicable laws, including the Fair Credit Reporting Act (FCRA) and the General Data Protection Regulation (GDPR).

3. User Obligations

• Provide accurate, complete, and truthful information.
• Maintain the confidentiality of any access credentials provided to you.
• Use the Services only for lawful purposes and in compliance with these Terms.
• Obtain all necessary consents and authorizations from individuals whose data is submitted for background checks.
• Comply with all applicable data protection and privacy laws.

4. Prohibited Conduct and System Integrity

• Using the Services for any unlawful or fraudulent purpose.
• Submitting false, misleading, or inaccurate information.
• Attempting to gain unauthorized access to our systems or data.
• Interfering with the proper functioning of our Services.
• Violating any applicable laws or regulations.

5. Intellectual Property

All content, features, and functionality on the Verified.ID website and Services, including text, graphics, logos, and software, are the exclusive property of Verified.ID or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

6. Disclaimers

Our Services are provided on an "as is" and "as available" basis. Verified.ID makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Services for any particular purpose. We do not warrant that the Services will be uninterrupted, error-free, or free from viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Verified.ID shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our Services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services, whether based on warranty, contract, tort, or any other legal theory, and whether or not Verified.ID has been informed of the possibility of such damage.

8. Indemnification

You agree to indemnify, defend, and hold harmless Verified.ID, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other right of any third party.

9. Governing Law and Jurisdiction

You agree that the Agreement and any claim, dispute, action, cause of action, issue, or request for relief arising out of or relating to the Agreement or your use of the Services shall be governed by the laws of the United States (including federal arbitration law) and the State of Georgia, without respect to its conflict of laws principles.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.
