1. Acceptance of Terms & User Roles

By accessing or using the Services—whether as a corporate client, prospective candidate, or active employee—you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must discontinue use immediately. You represent and warrant that you are at least 18 years of age and possess the legal authority to accept these Terms.

User Categories & Obligations:

  • Corporate Clients (“End Users”): You agree to obtain all legally required candidate authorizations and standalone consents under the Fair Credit Reporting Act (FCRA) prior to initiating screening. You assume full responsibility for executing mandatory Pre-Adverse and Final Adverse Action legal workflows.
  • Candidates and Employees (“Verification Subjects”): You agree to present genuine, unexpired, and unaltered identification documents. You warrant that all personal data provided belongs strictly to you. You explicitly consent to the capture of live video streams, IP addresses, device telemetry, biometric identifiers, and metadata solely for identity validation, employability verification, and fraud prevention.

2. Description of Services

VerifiedID provides comprehensive consumer background screening, credential authentication, and risk-mitigation solutions. The Services include:

  • Traditional Screening: Criminal background checks, employment/education verifications, motor vehicle records (MVR), drug screening, credit history checks, and reference verifications.
  • The TruCheck™ Suite: Interactive verification sessions featuring live video liveness assessments, cryptographic geolocation, IP auditing, multi-source data cross-referencing, and automated employment authorization evaluations (including Form I-551, Form I-767, Form I-94, and Form I-797 baseline matching via government endpoints such as the USCIS Torch API).

3. Data Retention, Account Closure & Deletion

To ensure compliance with data protection laws (including CCPA and FCRA), VerifiedID maintains clear rules regarding data lifecycle and account management:

  • Permanent Data Deletion SLA: Users have the right to request permanent deletion of their personal data at any time by emailing privacy.trucheck@verifiedid.co. VerifiedID will process and finalize permanent data deletion within thirty (30) calendar days of receiving a verified request, subject to mandatory legal retention exemptions.
  • Account Closure: Users may close their account at any time by contacting customer support at support@verifiedid.co or submitting a request in the account settings portal.
  • Dormant Account Retention Policy: Inactive or dormant accounts are maintained for seven (7) years to satisfy FCRA Section 605 statutory recordkeeping mandates and cross-tenant fraud detection rules. Upon the expiration of the seven-year retention window, all stored dormant account data and associated audit logs are automatically scrubbed and permanently erased from active systems.

  • Data Use & Sharing Restrictions: Collected data (including identifiers, biometrics, document images, and network telemetry) is used strictly to render verification services, detect fraud, and execute law enforcement compliance.
  • Third-Party Limits: Third-party use or disclosure of user information (including de-identified, anonymized, or pseudonymized data) for any purpose outside of rendering the TruCheck™ service is strictly prohibited without active user consent. All third-party sub-processors and infrastructure partners are contractually bound to the terms, security standards, and privacy protections set forth in our policies.

5. Prohibited Conduct & System Integrity

Users are strictly prohibited from compromising the security or integrity of the Services. You explicitly agree that you shall not:
